RN's Medication Administration Breaches Physician Orders
Nursing can be an extremely fulfilling and compassionate career choice, offering a profound opportunity to make a difference in people's lives. However, it is also a challenging field that requires a lot of time and dedication. In addition to working extended hours, nurses must adhere to strict regulations set by the Board. Sometimes, nurses may face challenges and risks, including legal issues and malpractice claims. However, by partnering with nurse defense attorneys, nurses can rest assured that they have a strong advocate on their side. Together let us discover how hiring a nurse defense attorney can make a big difference when facing such challenges.
Incident Scenario: Administration of Medication Outside the Parameter of a Physician's Order
On or about March 1, 2021, through March 24, 2021, while employed as an RN at a hospital in Abilene, Texas, RN administered medications to seven (7) different patients outside the parameter of a physician's order, without a pain scale and/or without documenting special instructions in the patient's medical record. RN's conduct was likely to injure the patients in that failure to administer medication as ordered by a physician, without a pain scale and/or without documenting special instructions could result in the patients suffering from adverse reactions.
Per the Texas Occupations Code Section 301.452(b)(10)&(13) the above action constitutes disciplinary action and is a violation of 22 TEX ADMIN. CODE §217.11(1)(A),(1)(B),(1)(C),(1)(D),(1)(N)&(1)(P) and 22 TEX. ADMIN. CODE §217.12 (1)(A),(1)(B),(1)(C)&(4).
However, during the board's investigation, the RN failed to consult with an experienced nurse attorney for the case, and without enough evidence to prove her innocence, the RN lost the case. Consequently, the Texas Board of Nursing placed her RN license under disciplinary action.
