RN Forcibly Administered a Medication Against Patient's Wishes

Patient autonomy and the right to refuse treatment are fundamental principles in healthcare, emphasizing the importance of respecting individuals' choices and preferences. However, instances where healthcare professionals allegedly act against a patient's wishes raise serious ethical and legal concerns. In situations where nurses face allegations related to actions against a patient's wishes, a nurse attorney can offer crucial assistance. Nurse attorneys possess a deep understanding of healthcare law and ethics, allowing them to navigate the complexities of cases involving patient rights.

At the time of the incident, he was employed as an RN at a healthcare facility in Sugar Land, Texas, and had been in that position for three (3) years.

On or about November 9, 2021, while employed as an RN at a healthcare facility in Sugar Land, Texas, the RN forcibly held down a patient's arm to administer D50W against his wishes. Subsequently, the RN admitted to his behavior involving this patient. RN's conduct was likely to cause emotional, physical, and/or psychological harm to the patient and could have interfered with or disrupted this patient's treatment.

The RN responded without seeking advice from a nurse attorney stating that he obtained the medication from the Pyxis and let the patient know that his blood sugar was 57 and that he was going to be giving him D50W through his IV to prevent it from dropping further. The RN stated the patient did not want to receive the medication and that he wanted to receive a sandwich. The RN stated that he reminded the patient that he could not have anything by mouth because of his procedure that day. The RN mentioned that the patient continued to refuse the medication and wanted to leave. RN stated he asked another nurse to call security. The RN also stated the patient began yelling saying he would punch and bite him if he tried to give him the D50W. RN stated he then held down the patient's arm and administered the D50W. RN stated in his intention to help he violated his patient's rights to refuse medication.

Unfortunately, the Texas Board of Nursing found him guilty of his actions. His RN license was subjected to disciplinary action. He did not hire a skilled Texas nurse attorney to fully defend his case which led to this decision by the Texas Board of Nursing.
