RN Fabricated Her Educational Credentials Over a Period of Time
When a nurse is accused of misrepresenting their education, it can be challenging allegations to face from the board. However, with the right guidance from a skilled nurse attorney, a nurse has a higher chance of defending her license and rights. Let us explore the case highlighted below and learn the essence of hiring a nurse license defense lawyer when facing allegations from the BON.
At the time of the initial incident, she was employed as an RN at a hospital in Killeen, Texas, and had been in that position for eight (8) years.
On or about September 6, 2012 to April 25, 2020, while employed as an RN at a hospital in Killeen, Texas, RN presented false documentation of the completion of an educational program and misrepresented on business cards, correspondence, and other work-related documents that she possessed the following credentials: Bachelor of Science in Nursing ("BSN"), Master of Science in Nursing ("MSN"), Master of Business Administration (MBA), and Master of Health Administration ("MHA"). RN's conduct deceived patients, co-workers, and the public into believing that she possessed educational credentials that she had not earned and may have caused harm to the facility in that she was unqualified for the leadership positions she held.
In response, without seeking advice from a nurse attorney the RN stated that she did falsify her credentials. RN stated that she was one class short of her BSN and intended to complete it and the graduate degrees but that long work hours and caring for her elderly parents prevented her.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13) Texas Occupations Code and is a violation of 22 TEX ADMIN. CODE §217.11(1)(A),(1)(B)&(1)(T) and 22 TEX. ADMIN. CODE §217.12 (1)(A), (1)(B),(1)(E),(4),(6)(A),(6)(H)&(6)(I).
The evidence against the RN was strong. At the same time, without the help of a nurse attorney, she was not able to properly defend her case in court. As a result, the Texas Board of Nursing placed her nursing license under disciplinary action.
