On or about August 9, 2021, and August 10, 2021, while employed as an RN at a rehabilitation facility in Fort Hood, Texas, RN lacked fitness to practice professional nursing in that RN exhibited erratic behavior consisting of screaming with the use of expletives, crying, and laying on the floor while on the unit and in front of residents, one of whom was negatively impacted by her actions. Furthermore, the RN appeared under the influence as she was witnessed speaking incoherently and slurring words. Additionally, when asked to complete a drug screen, the RN refused and departed the facility. RN's conduct could have affected her ability to recognize subtle signs, symptoms, or changes in patient's conditions, and could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing patients in potential danger.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10),(12)&(13) Texas Occupations Code, and is a violation of 22 TEX ADMIN. CODE §217.11(1)(B)&(1)(I) and 22 TEX. ADMIN. CODE §217.12 (1)(A), (1)(B),(1)(E),(4)&(5).
A case was ultimately filed against her before the Texas Board of Nursing (BON). The said allegation was fatal to the RN’s capability to perform the essential functions and duties. Sadly, the nurse defense attorney who handled her case was unable to properly defend her interests and rights before the Board. The Texas Board of Nursing (BON) found her guilty of the alleged offense in the complaint and decided to place her RN license under disciplinary action.
