RN Attempted to Obtain Cialis with Falsified Prescription

On or about January 13, 2021, while employed as an RN at a healthcare facility in McKinney, Texas, the RN attempted to obtain Cialis 20mg from a pharmacy, using a forged, falsified, unauthorized, and/or fraudulent prescription that contained the name and Drug Enforcement Administration (DEA) number assigned to a physician. RN's conduct was likely to deceive the pharmacy, and possession of Cialis through the use of a forged, falsified, unauthorized, prescription is prohibited by Chapter 483 of the Texas Health and Safety Code (Dangerous Drugs Act).
Without consulting with a nurse attorney, the RN responded to the above incident. RN stated that another RN wrote the unauthorized prescription for Cialis and forged the physician's signature. RN stated he only wrote down his name, date of birth, and address on the prescription pad and later faxed the prescription to the pharmacy. RN stated the medication was not dispensed by the pharmacy.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10) Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.12 (1)(B),(4),(6)(H),(10)(E)&(11)(B).
A case was ultimately filed against him before the Texas Board of Nursing (BON). The said allegation was fatal to the RN’s capability to perform the essential functions and duties.
