LVN was Alleged of Diverting Prescriptions for Personal Use

The responsibility of an LVN in a nursing and rehabilitation facility is grounded in ensuring the safe and accurate administration of medications to residents. In situations where a nurse is facing accusations of misappropriation of medications, the support of a nurse attorney can be instrumental. A nurse attorney can provide valuable guidance on how to address the allegations, ensuring that the nurses' rights are protected and working toward a resolution that is fair and just.

At the time of the incident, she was employed as an LVN at a nursing and rehabilitation facility in McAllen, Texas, and had been in that position for one (1) year.

On or about June 27, 2021, while employed as an LVN at a nursing and rehabilitation facility in McAllen, Texas, LVN misappropriated two (2) blister packs of Furosemide 20mg, one (1) blister pack of Furosemide 40mg, and two (2) blister packs of Lisinopril 20mg, from the patients, and gave the medications to a nurse's aide, who was not a registered patient, for her personal use. LVN's conduct was likely to defraud the facility and patients, thereof, of the cost of the medications.

In response, LVN stated she did take medications and give them to a Certified Nursing Assistant at the facility who had medical issues and could not afford the medications. LVN explained she got the medications out of the discontinued medications bin and that the medications were non-narcotic and were being sent for destruction. LVN relates she had no intention of defrauding the patients or the company.

However, without seeking advice from an experienced nurse attorney and without enough evidence to prove she was not guilty, the LVN lost the case. This is the reason why the Texas Board of Nursing placed her LVN license under disciplinary action.
