LVN was Accused of Falsifying Visit Records and Task Documentation
Pediatric healthcare is a specialized field that requires nurses to document their work with utmost accuracy. However, despite their best efforts, nurses may sometimes face accusations of making mistakes in their records or behaving unprofessionally. In such scenarios, seeking help from a nurse attorney becomes necessary.
At the time of the initial incident, she was employed as an LVN with a pediatric home health service provider in Allen, Texas, and had been in that position for five (5) years and eleven (11) months.
On or about February 13, 2021, while employed as an LVN with a pediatric home health service provider in Allen, Texas, and assigned to care for a patient, LVN falsely documented her arrival/departure times and tasks completed in the visit notes that she did not complete. LVN's conduct was deceitful and created an inaccurate medical record.
Without the guidance of a nurse attorney, LVN responded and explained that she was scheduled for a 12-hour shift (8a-8p), but unfortunately, there was so much snow that she was "some minutes late" but the parents completely understood. The LVN stated around 530pm the mom suggested she should leave since she completed almost everything, and the weather was getting worse. LVN stated she received more education on documentation and her paycheck for that shift was delayed for weeks but was later paid for the time worked. The LVN apologized for misunderstanding Mom's instructions.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13) Texas Occupations Code and is a violation of 22 TEX ADMIN. CODE §217.11(1)(A),(1)(B)&(1)(D) and 22 TEX. ADMIN. CODE §217.12 (1)(A), (1)(B),(1)(C),(6)(A),(6)(H)&(10)(B).
The evidence against the LVN was strong. At the same time, without the help of a nurse attorney, she was not able to properly defend her case in court. As a result, the Texas Board of Nursing placed her nursing license under disciplinary action.
