On or about July 12, 2021, while employed as an LVN at a medical facility in New Braunfels, Texas, the LVN failed to check the hospitalist's orders prior to discharging a patient, who had been admitted for dysphasia. As a result, the patient was discharged without receiving the physician-ordered Speech Therapy and Dietary consults. In response to the above incident, LVN admits she missed the orders for the Speech and Dietary consult and reported it to her doctor who ordered outpatient testing.

The action detailed above is considered a valid reason for disciplinary action per the Texas Occupations Code. If found guilty, the Texas Board of Nursing may take various actions, including but not limited to, issuing a reprimand, placing restrictions on the nurse's license, suspending or revoking the license, or imposing fines.

The Texas Board of Nursing then subjected the LVN’s license to disciplinary action including temporary suspension of her license and taking a remedial education. The accusation would have been defended by an experienced and skilled nurse attorney if the LVN hired one. Hiring a nurse defense attorney can be crucial in such situations, as they can help in guiding how to respond to allegations, and advocating for the nurse's rights and interests before the Board.
