LVN Falsified Assessments and Neglected Critical Patient Monitoring
LVN Falsified Assessments and Neglected Critical Patient Monitoring
The accuracy and precision of medical documentation are foundational elements of ethical patient care. However, when situations arise where medical records are inaccurately documented, it not only raises concerns about transparency but also poses potential consequences for patient well-being. In instances like these, the involvement of a nurse attorney becomes paramount, addressing the legal and ethical intricacies surrounding accurate medical documentation and ensuring adherence to healthcare standards. The expertise of a nurse attorney is crucial in maintaining the integrity of healthcare practices while upholding patient safety.
At the time of the initial incident, she was employed as an LVN at a hospital in Denton, Texas, and had been in that position for three (3) years and two (2) months.
On or about May 23, 2022, while employed as an LVN at a hospital in Denton, Texas, LVN was accused of the following:
- LVN documented that fall risk and focused assessments were performed for a patient after the patient had already been discharged. LVN's conduct was deceptive, resulted in an inaccurate medical record, and was likely to injure the patient from subsequent care decisions made without the benefit of reliable information.
- LVN failed to assess a patient, and instead falsely documented a shift assessment. The patient experienced abnormal vital signs and was subsequently found unresponsive, and a code blue was initiated.
The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13) Texas Occupations Code and is a violation of 22 TEX ADMIN. CODE §217.11(1)(A),(1)(B),(1)(D),(1)(M)&(3) and 22 TEX. ADMIN. CODE §217.12 (1)(A),(1)(B),(1)(C),(4)&(6)(A).
However, the LVN did not consult with a nurse defense attorney, and without enough evidence to prove her innocence, the LVN ultimately lost the case. This is the reason why the Texas Board of Nursing placed her LVN license under disciplinary action.
