Malpractices have been a signature specialty of a Texas BON attorney when handling cases for some nurses. However, some nurses tend to forget this fact because they really felt like they should be responsible even if they never intended to commit such an error.
On or about October 23, 2019, an RN from Houston falsely documented a physician telephone order to administer Benadryl 50 mg at bedtime for seasonal allergies for a patient. The resident had no diagnosis of seasonal allergies, and was administered Benadryl for five (5) days. The RN’s conduct was likely to injure the patient from adverse effects of taking a medication that was not ordered by the provider.
This issue was filed as a complaint and sent to the Texas Board of Nursing. The Texas Board of Nursing has full jurisdiction in all cases that may affect the status of an RN or LVN’s license in the future. But they advise nurses to attend a hearing first before placing the sentence, which the RN attended for her career’s security.
During the hearing, the RN states that she was hired on September 17, 2019, that she had no orientation, and was thrown into the ADON position full swing. She states that she had worked or been on call for fifteen (23) to eighteen (26) days before the incident. The RN states that the Director of Nursing (DON) resigned the day before the incident as the facility conditions were so bad, leaving her to run the nursing department.
As a result, the Texas Board of Nursing placed her RN license to disciplinary action. It’s too bad that she failed to hire a Texas BON attorney for assistance, knowing that she had every reason to defend herself in the first place. Her defense would have gotten better if she actually sought legal consultation from a Texas nurse attorney as well.
