Apparently, the controlled substances were not administered to the patients or residents during August 13, 2003, to October 13, 2003. An investigation within the facility was initiated on October 24, 2003, which showed that none of the medications remained on the facility’s premises.

The RN’s misconduct was deceptive and defrauded the residents and the facility of the medication’s costs. It also placed the hospital under violation of the Texas Health & Safety Code. This type of case may highly likely lose the LVN’s license, as the amounts of medication tablets received by the LVN has reached around 300 tablets. The resulting action may also lead towards impaired nursing case as the LVN might have used the substances as well.

The Texas Board of Nursing was not able to reach out to the LVN due to the actions that she did. However, there was enough evidence which proved the errors of her actions, such as a facsimile showing that her physician never ordered her to receive or use the said medications. Additionally, she failed to hire a nurse attorney for assistance, causing her to lose her LVN license.
