On or about May 1, 2018, the LVN was arrested for 1 COUNT OF ACCIDENT INVOLVING INDEATH, a 3rd Degree Felony offense.
On or about August 10, 2018, she entered a plea of Guilty and was convicted of TERRORISTIC THREAT, a Class B misdemeanor offense committed on May 1, 2018.
As a result of the conviction, the LVN was sentenced to jail and her license was suspended.
In response to complaints filed against her, the LVN states she was leaving a local hardware shop in Sherman, Texas. She was in a hurry to get home to a plumbing problem.
After driving onto highway 82, she heavily engaged her throttle to pass a vehicle. Upon making the lane change and approaching the off ramp, she came upon a vehicle driving at a very slow rate of speed entering the offramp. She disengaged her throttle, but there was no response.
She immediately begin to brake while her throttle was still engaged. She was able to brake enough that only slight contact was made on three instances with the vehicle in front of her. After the third contact was made she was able to kick at her throttle peddle enough to cause it to break free from the floor mat which it had become stuck up under.
When she exited her vehicle the man from the other car came rushing over in a panic and upset state. She tried to explain what happened, the man yelled something at her. They each returned to their vehicles the other man very upset and rightfully so.
As she was dialing 911 she heard the women passenger in the other car say get back in the car and put that back. He had something in his hand. She became afraid that he may be armed and she proceeded to leave the scene and get distance from him. From that point she made one of the biggest mistakes.
There was no damage to either vehicle and she decided to let things be. She was very shook up as well and decided not to push the issue and drove home. Over a year had passed and she was returning from assignment in New Mexico.
Local police came to her home to inform her she had a warrant for her arrest. She was driving a Toyota Tacoma and there was a safety recall for the throttle being stuck under the floor mat. A plea bargain was made by the DA.
Due to these events, the Texas Board of Nursing found her guilty and her license was put into danger.
