Every RN or LVN subjected to a disciplinary proceeding or administrative case before the Board is given an opportunity to be heard and defend himself from all accusations. Every nurse with a pending case before the Texas Board of Nursing (BON) is to encourage hiring a nurse attorney.

At the time of the incident, an RN was employed as a Registered Nurse at a health facility in Allen, Texas, and had been in that position for one (1) year and one (1) month.

On or about June 14, 2019, through July 28, 2020, while employed as a Registered Nurse, the said RN was paid thirty-six thousand two hundred eighty-seven dollars and thirty-nine cents ($36,287.39) for hours he did not actually work. Specifically, the RN entered the facility to clock in on his days off, but then left the facility and did not physically stay on the unit. The action of the RN was likely to defraud and deceive the facility of money paid to the RN for hours not actually worked.

In regards to this, the said RN admits he was transparent about this matter with his employer and entered into a wage deduction agreement which allowed his employer to retain any and all wages still owed. It was further stated by the RN that he didn’t have another source of income as the wages deducted were all the income he had access to and was in lieu of further restitution given that he was insolvent at the time.

Because of this, the RN was summoned by the Texas Board of Nursing to give her a fair chance to defend her case. She was given the chance to defend herself at the Board. However, the Texas Board of disciplined and suspended her nursing license.

The Texas Board of Nursing (BON) found her guilty of the complaint against her and her RN license was suspended. She lost the case simply because the RN failed to find an effective and efficient nurse attorney. Avoid committing the same mistake she did.
