Healthcare is a field that requires careful and timely patient assessments to ensure proper care and avoid complications. However, nurses may face accusations of neglecting these assessments, leading to legal and professional challenges. This is where a nurse attorney can help. By providing legal guidance and support, they can help nurses manage the complexities of disciplinary proceedings, as well as ensure a comprehensive and fair evaluation of the circumstances. A nurse defense attorney can be a valuable resource for nurses who want to protect their careers and uphold the highest standards of patient care.

At the time of the initial incident, she was employed as an RN at a hospice in Georgetown, Texas, and had been in that position for seven (7) months.

RN failed to assess the patient after noting, on June 11, 2021, that the patient still had staples in his left hip from hip surgery on April 14, 2021. As a result, the staples remained in the patient’s left hip. The patient was subsequently admitted to the hospital on July 13, 2021, where the staples were surgically removed, and he received treatment for sepsis. RN’s conduct may have contributed to the patient’s infection and subsequent hospitalization.

The RN responded to the allegations, without the help of a nurse defense attorney. The RN stated she was unaware that the patient had staples in his left hip from surgery as those should have been removed 10-14 days after surgery. She identified the staples on June 11, 2021, and immediately notified her clinical supervisor and the group homeowner. Her clinical supervisor informed her that she would notify the medical director so that appropriate action could be taken. RN was never provided with any further information or direction on the matter and believed that the matter had been addressed before her next weekly visit.

The RN failed to consult with an experienced nurse attorney for the case and without enough evidence to prove she was not guilty. As a result, her RN license was placed under disciplinary action by the Texas Board of Nursing.
