On or about October 30, 2019, while employed as a Licensed Vocational Nurse with Pediatric Healthcare Connection, Austin, Texas, the LVN failed to completely/accurately assess the integrity of the tracheostomy placement and/or timely change the tracheostomy of the patient. when he displayed signs and symptoms of respiratory distress and failed to correctly perform cardiopulmonary resuscitation (CPR) on the Patient by placing the patient on a firm surface prior to initiating compressions and monitoring the rise and fall of the patient’s chest so as to ascertain the effectiveness of rescue breathing. The LVN’s conduct could have delayed emergent resuscitation efforts. 

The LVN states that she checked for placement of the tracheostomy and checked for patency concerning the events. She also states that she placed patients on a large, firm lounge chair rather than the floor because she did not want to pull out his lines and ventilator tubing. The LVN believes the lack of communication from the family contributed to the situation. 

Despite her explanation, the Texas Board of Nursing still placed her under disciplinary action. Hiring the right nurse attorney for this case would be of great help, knowing that she has a defense to the accusations.
