At the time of the initial incident, he was employed as an RN at a hospital in Bryan, Texas, and had been in that position for seven (7) months.

On or about October 16, 2020, while employed as an RN at a hospital in Bryan, Texas, the RN improperly restrained three patients in that he grabbed the patients and pushed them into a wall in an attempt to prevent a fight between patients. In addition, the RN inappropriately restrained a patient to the ground with his arm around her head. RN’s conduct was likely to injure the patients in that the use of improper restraints could result in the patients suffering from adverse reactions and/or physical, mental, or emotional harm.

In response, the RN states he was working the night shift in the Psychiatric Intensive Care Unit when he received a Code Purple call. This indicates a need for a staff to support a unit disturbance in the adolescent female unit as a group of female adolescents were attempting to form a group to attack another patient who was instigating the group. Accordingly, previous attempts to verbally de-escalate the patients had been unsuccessful. The patients began damaging hospital property and attempted to jump over the nursing station, despite instructions from the unit nurse and the house supervisor. RN discloses he attempted to form a barrier between himself and the patient but one of the other patients got within close proximity and started physically posturing toward the singled-out patient. He further claims he told the patient multiple times to step back, but the patient ignored him and stepped forward, yelling verbal threats to the patient and attempted to attack the other patient. Out of his concern for the safety of the patient, he moved the patient against the wall to prevent an attack. Another patient struck him in the face, injuring the right side of his face, so he reflexively pushed the patient away and released the other patient from against the wall. He then disengaged himself from the situation but stayed on the unit. RN states one of the patients attacked the nurse manager, while the patient who had previously struck RN began to yell obscenities and threats of physical harm. RN backed away from her, urging her not to attack him. He was then distracted by a loud sound, when the patient attempted to strike him while his back was turned toward the noise. RN claims he attempted to defend himself and restrained the patient to prevent further attacks on his face and later released the patient once the staff noticed she was attacking him. RN states he understood that his patient was at risk of harm when surrounded by other patients and that it was his responsibility to protect her.

A case was ultimately filed against him before the Texas Board of Nursing (BON). The allegation was fatal to the RN’s ability to perform the essential functions and duties, and their defense attorney failed to defend their interests before the board. As a result, the Texas Board of Nursing found the RN guilty of the alleged offense and placed their RN license under disciplinary action.
