Her conduct was likely to injure the patients, in that the administration of medications without a valid physicians order could result in the patient suffering from adverse reactions, and her conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

The Texas Board of Nursing is the one who has full jurisdiction on cases involving RNs and LVNs. Therefore, the RN was summoned by the Texas Board of Nursing to explain her side. The LVN denies giving excessive amounts of medication to patients, but does admit to occasionally deviating from the physicians order or the sedation protocol for sedating ventilated patients with Fentanyl. Respondent states she now realizes it was inappropriate and outside her scope of practice to deviate from the physicians order.
