Friendliness and approachable should be some of the nurse’ most valuable assets. This is the main reason why whenever someone filed a complaint against you involving this issue, your license could be put in danger if not defended by a nurse attorney.

On or about July 16, 2013, through August 16, 2013, while employed as a Registered Nurse in a medical facility in Cedar Park, the RN withdrew Fentanyl, Propofol, and Demerol from the Medication Dispensing System for patients without a valid physicians’ order. Her conduct was likely to injure the patients, in that the administration of medications without a valid physicians order could result in the patient suffering from adverse reactions, and her conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

The Texas Board of Nursing is the one who has full jurisdiction on cases involving RNs and LVNs. Therefore, the RN was summoned by the Texas Board of Nursing to explain her side. The LVN denies giving excessive amounts of medication to patients, but does admit to occasionally deviating from the physicians order or the sedation protocol for sedating ventilated patients with Fentanyl. Respondent states she now realizes it was inappropriate and outside her scope of practice to deviate from the physicians order.

However, the RN without the help of an experienced nurse attorney to help her defend her case, the Texas Board of Nursing suspended and disciplined the RN.

The Texas Board of Nursing decided to revoke her license as a result of her actions. It’s because she failed to hire a good nurse attorney for the case, which is why her defense was not matched with the evidence that the Board possesses.
