Whenever someone filed a complaint against you involving negligence at work, your license could be put in danger if not defended by a Texas BON case attorney. A RN from Houston, Texas is just one of the many examples of nurses who were found to be negligent while on duty.

On or about March 10, 2019, through February 13 , 2019, while employed in a medical facility in Houston, the RN changed her work schedule to work nights for five (5) shifts without prior authorization or orientation to a patient’s night time equipment. The patient who had a diagnosis of sleep apnea had orders to use a Continuous Positive Airway Pressure (CPAP) device while sleeping.

However, the LVN failed to follow the physician’s order because she did not know how to use the machine. Her conduct was likely to injure the patient who needed the CPAP machine to keep his airway open to facilitate his breathing throughout the night.

Because of this, the LVN was summoned by the Texas Board of Nursing to defend her side. In response to the accusations filed against her, the LVN states there wasn’t a CPAP machine in the patient’s home, so she was unable to put him on it. She also states she was not trained on the use of the machine and thought the hospital was aware of the event. The LVN admits to changing shifts without notification and states she did report the machine was not there when it was never delivered.

However, without valid evidence to defend her side of the story, the LVN lost the case.

Furthermore, the LVN failed to hire a Texas BON case attorney to help her with her case. Because of this, the Texas Board of Nursing suspended and disciplined the LVN.
