Missed documentation and failure to administer medicine in a timely manner are some of the typical errors or mistakes committed by any nurse. These mistakes may become grounds for nursing malpractice, and if you are accused, you need the right and skilled nurse attorney to help you with the case.

On or about March 5, 2020, while employed as an LVN with a staffing agency and assigned at a hospital in Wichita Falls, Texas, LVN withdrew Norco 10/325mg from the medication dispensing system for a patient but failed to document and/or accurately and completely document the administration of the medication in the patient’s Medication Administration Record (MAR) and/or Nurses’ Notes. LVN’s conduct was likely to injure the patient, in that subsequent caregivers would rely on her documentation to further medicate the patient, which could result in an overdose. Additionally, LVN’s conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

In response to the above incident, LVN states she administered the Norco to the patient and that she takes full responsibility for not documenting it.

The above action constitutes grounds for disciplinary action in accordance with the Texas Occupations Code and is a violation of 22 TEX. ADMIN. CODE.

Because of this, the LVN was summoned by the Texas Board of Nursing to defend her side but the LVN failed to hire a nurse attorney to help her with her case and without proper defense, the Texas Board of Nursing then decided to place her LVN license under disciplinary action.

If you ever find yourself in a similar predicament, it would be best to seek the assistance of a knowledgeable nurse attorney, as it may put you at a greater advantage. Look for an experienced nurse attorney who’s handled and is familiar with a wide range of issues related to medical litigations.
