An allegation or complaint could be a serious case, which is why a nurse defense attorney is needed if you get accused of this kind of scenario. Her conduct was likely to injure the patient, in that subsequent caregivers would rely on her documentation to further medicate the patient, which could result in an overdose. Additionally, Respondent’s conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

Subsequently, the LVN also failed to take precautions to prevent the misappropriation of one (1) injection of pain medications 2mg/1ml belonging to the facility and patient thereof.

As part of the defense, the LVN denied all the accusations against her. She says that she is doing everything she can to do her job well. However, without the help of a good nurse attorney, the LVN failed to defend her case. The result is a suspension and discipline by the Board of Nursing.
