Any type of allegations or accusations at work can be defended, as long as there is a reliable and skilled nurse attorney ready to assist you during the hearing before the Board of Nursing. On or about March 25, 2015, the LVN failed to maintain a safe environment for her patients in that she exited the facility and failed to ensure that the exit door was locked. As a result, the patient eloped from the facility through the unlocked door and was later discovered by law enforcement with injuries to his face, hands and knees.

The patient was taken to the emergency department for treatment of his injuries. The LVN’s conduct unnecessarily exposed the patients to risk of harm and may have contributed to the patient’s injuries.

Because of this, the LVN was summoned by the Texas Board of Nursing. During the defense, she states that she fully understands the importance of securing exits in order to provide a safe environment for their vulnerable population. The LVN adds that in a locked facility, unlocking and locking doors is done with such frequency that over time the action can become almost unconscious. The LVN further states that since this incident, her own consciousness regarding the locking of doors has risen significantly and he assures the Board that she will not fail to secure any door in any patient area again.

However, with the failure to hire an experienced nurse attorney to help her defend her side, the LVN never had the chance to defend her side of the story.

Because of this incident, the Texas Board of Nursing then subjected the LVN and her license into disciplinary action.
