All LVN or RN is under the jurisdiction of the Texas Board of Nursing (BON). All complaints or cases concerning the practice of the LVN or RN license are lodged before the Texas Board of Nursing (BON). Thereafter, the members of the Board will hear the case and decide on the issues or matters submitted for resolution. The parties charged are given an opportunity to be heard. This is part of their right to due process.

In one of the recent cases decided by the Texas Board of Nursing (BON), a RN failed to hire an experienced nurse attorney to defend her license. Before a case was filed against her, she was employed as a staff nurse in a state hospital.

On or about March 23, 2018 through March 25, 2018the RN lacked fitness to practice professional nursing in that she appeared manic, had bum marks on her face, could not focus, and could not sit down to give report. She failed to submit to a urine screen for reasonable suspicion. In addition, the RN tried to sneak in an object in her underwear and refused to remove the object when asked by staff; therefore, the test could not be completed.

On March 30, 2018, she was referred to the Board. The RN admitted that she relapsed in February, it was not isolated and that she started using again a few weeks ago.

Unfortunately, she failed to properly defend her case upon the Texas BON. She was disciplined and her RN license was suspended.
