Any cases involving nursing committing mistakes while at work have been a signature specialty of a Texas nurse attorney when handling cases for some nurses. However, some nurses tend to forget this fact because they really felt like they should be responsible even if they never intended to commit such an error.
On or about May 2018, while employed as a Licensed Vocational Nurse (LVN) in a medical facility in Silsbee, the LVN exceeded her scope of practice when she failed to make an appropriate assignment to an unlicensed person in that performance of an I&O catheterization requires delegation by a Registered Nurse (RN). Her conduct was likely to injure the resident in that the unlicensed employee did not have the education and skills necessary to safely perform the delegated task.
This issue was filed as a complaint and sent to the Texas Board of Nursing. The Texas Board of Nursing has full jurisdiction in all cases that may affect the status of an RN or LVN’s license in the future. But they advise nurses to attend a hearing first before placing the sentence, which the RN attended for her career’s security.
In response to the incident, the LVN states she doesn’t recall ever delegating an I&O cath to anyone. She also states she was informed by the other nurses at the hospital that a nursing student could perform this task with supervision.
As a result, the Texas Board of Nursing placed his LVN license to disciplinary action. It’s too bad that she failed to hire a nurse attorney for assistance if she had every reason to defend himself in the first place. Her defense would have gotten better if she actually sought legal consultation from a Texas nurse attorney as well.
This is just one of the many cases why every nurse in Texas is expected to act with prudence in practicing the profession. Any form of gross negligence, disobedience or any form of offense on the part of a RN or LVN is never excused.
