An RN is expected to do their job right including proper interventions in a timely manner whenever a patient needs it. Any form of negligence on their responsibilities can cause harm to the patients and could put their license in danger. But a nurse attorney can help them fight the cases filed against an RN.

At the time of the initial incident, an LVN was employed as a Licensed Vocational Nurse at a hospital in Plano, Texas, and had been in that position for one (1) year and three (3) months.

It was on or about March 27, 2019, the LVN failed to intervene in a timely manner for the patient who was on the floor and complaining of non-specific pain. The LVN admitted she left the patient on the floor and unattended while she continued to deliver meal trays to other residents in order to make good use of her time while waiting for the Certified Nursing Assistant (CNA) to return with a Hoyer lift to assist with placing the patient back in bed. The LVN’s conduct was likely to injure the patient from unknown and/or undetected changes in condition and may have contributed to the patient’s demise.

Then on or about March 27, 2019, the LVN failed to initiate Cardio Pulmonary Resuscitation (CPR) in a timely manner to a patient, who was showing signs of difficulty breathing and complaining of non-specific pain. A few minutes later the patient became unconscious and CPR was initiated by the CNA. The LVN admits once the patient became unconscious she left the patient’s room to call the physician for orders to transfer the patient to the emergency room. Shortly afterward, the patient was pronounced dead.

In response, the LVN states she found the patient on the floor next to her bed while delivering dinner trays. The LVN states she performed an assessment, then left the patient’s room in search of a CNA to retrieve a Hoyer lift in order to get the patient off the floor. The LVN states while waiting on the CNA to return, she decided to use her time wisely by resuming delivery of dinner trays to other patients. Once the patient was being lifted into bed, she started having difficulty breathing and became unconscious. The LVN admits that she left the CNA who initiated CPR with the patient while she left the patient’s room to call the physician for an order for the transfer to the emergency room. Shortly, after the patient expired.

This became a problem for the LVN, due to the incidents; the Texas Board of Nursing had placed the LVN into disciplinary action. This had to happen as the LVN had failed to hire a nurse attorney as a legal counsel before facing the Board. This could have led to a different outcome if only the LVN consulted and hire a nurse attorney.
