An experienced and skilled nurse attorney has surely helped a lot of RNs and LVNs when it comes to cases that may lead to disciplinary action. Unfortunately, not all nurses were able to hire a nurse attorney as they underwent such cases. This incident that the LVN from Stafford committed in January 2017 was one of those examples.

On or about January 1, 2017, through January 31, 2017, while employed as a Licensed Vocational Nurse in a healthcare facility in Stafford and assigned to provide care to a patient, the LVN failed to notify her supervising nurse and the treating physician of the stage 4 decubitus ulcer on the patient’s coccyx.

Consequently, the ulcer went unreported and untreated until the patient was seen by his primary care provider on February 1, 2017. The LVN’s conduct was likely to injure the patient from a lack of required medical care.

Because of the incident, the RN was summoned by the Texas Board of Nursing to hear her side. She states she informed the patient’s mother of the skin abrasion to the mid-sacrum and documented this action in her narrative. She states the patient’s mother instructed her not to treat or dress the wound as she was going to take care of it.

The LVN further states she did not think it necessary to report the issue to her supervisor as it was only a skin tear, but in retrospect, she understands her failure to inform her supervisor of the patient’s condition could have caused him more harm than good, which was not her intention. She states she is greatly remorseful for her inaction.

The following incident and defense against the case caused the Texas Board of Nursing to place the RN and her license into disciplinary proceedings. She would have sought assistance from a good nurse attorney to provide clarifications towards the case.
