The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney. On or about December 11, 2014, the LVN was charged and convicted of PAYMENT OF ILLEGAL KICKBACK. As a defense to the accusations against her, she states the facts of the underlying conviction show while accepting responsibility for her actions was caught up in business activities principally run by her husband who has since been sentenced and is serving a prison sentence.
She states she trusted her husband and asked too few questions until it was too late. She accepts full responsibility for her part in the entire matter. The LVN further states the facts of the case do not indicate or suggest any evidence of actual or potential harm to patients or clients. She states the factual allegations relate to financial incentives or rewards to potential patients and clients.
The LVN states she has practiced since August 2013 without a complaint or reported violation of any Board of Nursing rules. She states the entire criminal process was a new and frightening process. She states the whole experience has sufficiently chastened and rehabilitated her that a reoccurrence is highly unlikely.
The LVN states any disciplinary action that substantially subscribe her ability to engage in gainful employment in the only profession she is trained in, essentially sets her up to fail in meeting the conditions of her supervision. She states she is the sole provider of her family. She states she does not pose a risk to the public safety.
As a result conviction, the LVN was sentenced to probation and ordered to pay an amount. She was disciplined warning of suspension of her LVN license by violating the Texas Board of Nursing regulation.
