This is why the assistance and help of a nurse attorney are valuable if you’re facing complaints, accusations, or any case before the Texas Board of Nursing. Your defense will strengthen further if you’re able to get the help of an experienced and skilled nurse attorney in facing the Texas Board of Nursing. There are times when mistakes at work could be inevitable, which is why a nurse attorney can assure full assistance over such errors.

At the time of the initial incident, an LVN was employed as a Licensed Vocational Nurse at a hospital in Brownsville, Texas, and had been in that position for ten (10) months.

On or about July 22, 2017, while employed as a licensed vocational nurse, the LVN removed Tylenol #3 from the medication dispensing system of a patient, who had been discharged for three (3) days but failed to follow the facility’s policy and procedure for wastage of the unused portion of the Tylenol #3. The LVN’s conduct left medications unaccounted for, was likely to deceive the pharmacy, and placed the pharmacy in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

On or about July 22, 2017, while employed as a licensed vocational nurse the LVN misappropriatedTylenol #3 belonging to the facility or patients thereof, or failed to take precautions to prevent such misappropriation. The LVN’s conduct was likely to defraud the facility and patients of the cost of the medications.

In response to the incident, the LVN denies the conduct outlined above. Although the LVN denies the accusation, the LVN was still put into discipline by the Texas Board of Nursing. However, without the help of an experienced nurse attorney will lead to the discipline of her license.
