Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case. On or about January 1, 2017, an LVN from Houston signed in to provide in-home care for a female patient. During the LVN’s shift, the said patient died. The patient had standing orders for pain relief medication, 5-10mg every 3 to 4 hours as needed.

A chronic painkiller is a Schedule II controlled substance that has a high potential for abuse and has a currently accepted but severely restricted medical use in treatment in the patient. Abuse of such pain medication may lead to severe psychological or physical dependence.

On or about January 1, 2017, the LVN documented flushing 50 units of the chronic painkiller (20mg/ml) and 15 units of the pain medication (20mg/ml) with a family member witnessing the waste.

The following day, the hospital where the LVN was employed treated the LVN for poisoning. She admitted drinking a small amount of the controlled substance she obtained from a recently deceased patient.

During that time, the LVN did not have a valid prescription for the chronic painkiller or a legitimate medical reason for using such medication.

The Texas Board of Nursing then subjected the LVN and her license to disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one.
