In the demanding field of healthcare, RNs play an essential role in patient care and safety. However, there are instances where lapses occur, such as failing to notify a physician and accurately document a patient’s breathing status. These errors can lead to serious consequences, including inaccurate medical records and compromised patient outcomes. When an RN faces allegations of such professional misconduct, the expertise of a nurse attorney becomes invaluable. A Texas nurse attorney specializes in navigating the complex legal landscape of healthcare, providing essential support and advocacy.

At the time of the initial incident, he was employed as an RN at a medical facility in Mesquite, Texas, and had been in that position for twelve (12) months.

On or about January 17, 2021, while employed as an RN at a medical facility in Mesquite, Texas, RN failed to appropriately notify the on-call critical care physician while monitoring a patient, who was being treated in the intensive care unit for severe cerebral malaria. In one nursing note, RN failed to accurately document the patient’s breathing status. RN’s conduct created an inaccurate medical record.

The RN responded to the above allegations and stated that the patient’s vital signs were continuously monitored in the ICU. RN also states upon noting an elevated blood pressure of 173/101 mm/Hg, he assessed the patient for pain and administered previously ordered Morphine, as indicated by the results of the assessment. RN further stated the physician was contacted upon reassessment of the patient’s vital signs, and received a verbal order for Hydralazine, which was administered. The physician was called on two additional occasions and informed of the patient’s condition. That physician provided an expert report and letter of support of RN indicating that the physician thought he was appropriately informed of the patient’s status at all times during RN’s shift. An expert report from an additional board-certified critical care physician was provided and indicated that no additional medical interventions would have created a different result for this patient. An expat report from a critical care registered nurse was also provided that indicated that RN’s care and documentation were appropriate.

The evidence presented against the RN was compelling, and without the support of a nurse attorney, he struggled to build a robust defense when facing the Texas Board of Nursing. Engaging with a Texas nurse attorney could significantly enhance her ability to formulate a strong defense against the allegations.
