The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney.

On or about September 13, 2017, an RN from Austin withdrew 4mg of Morphine from the Medication Dispensing System for a patient but held the medication for two (2) hours before administering to the patient. Her failure to secure the Morphine placed the facility in violation of Chapter 481 (Controlled Substance Act) of the Texas Health and Safety Code.

On or about September 14, 2017, through September 21, 2017, the RN withdrew 2mg Morphine, 4mg of Hydromorphone, one (1) tab of Hydrocodone/APAP 7.5/325mg, one (1) tab of Oxycodone/APAP 5/325, and one (1) tab of Oxycodone APAP 10/325mg from the Medication Dispensing System for patients but failed to document and/or accurately and completely document the administration of the medications in the patients’ Medication Administration Records.

The RN stated during the hearing that a new computer system was introduced in May and the system was constantly freezing or booting you out without warning, or would go down for maintenance during the night shift. She states she was told to chart as fast as she could, and get as much done as possible before the system would crash. She states she would have to switch to downtime forms at random. At times, she states she was told not to worry about the downtime form that it was extra that no one will even look at.

However, due to her failure to hire an experienced nurse attorney, her license was disciplined by the Texas Board of Nursing.
