Any type of accusations can be defended, as long as there is a skilled and a reliable nurse attorney ready to assist you during the hearing before the Board of Nursing. The Texas Board of Nursing has full jurisdiction regarding cases that may affect an RN or LVN’s license from suspension, disciplinary action or revocation.

On or about August 21, 2013, an LVN from Lubbock engaged in the intemperate use of Soma (Carisoprodol) in that she produced a specimen for drug screening which resulted positive for Soma(Carisoprodol).

She later admitted to taking what she thought was a family member’s muscle relaxer. Possession of Soma is prohibited by Chapter 481 of the Texas Health & Safety Code (Controlled Substances Act). The use of Soma by a Registered Nurse, while subject to call or duty, could impair the nurse’s ability to recognize subtle signs, symptoms or changes in the patient’s condition, and could impair the nurse’s ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

When summoned by the Texas Board of Nursing, the LVN explains she went to a family reunion and had pain under her left shoulder blade so her great aunt gave her a couple of muscle relaxers. She states she believed the medication appeared to be Robaxin.

Unfortunately, the Texas Board of Nursing believed that there is not enough evidence to support the LVN’s defense.

Because of this incident, the Texas Board of Nursing then subjected the LVN and her license into disciplinary action.

The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one. Hiring a nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.
