Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case. The Texas Board of Nurses is responsible for all hearings against RNs and LVNs undergoing a case that may revoke suspend or only discipline their license. Take note that a nurse attorney can also defend a nurse’s license against accusations or allegations.
On or about January 27, 2017, while employed as a Licensed Vocational Nurse in a nursing home in Fort Worth, the LVN misappropriated Hydrocodone 10/3 25 belonging to the facility and failed to take precautions to prevent such misappropriation.
Additionally, she was also seen on surveillance video entering the medication room with a large bag, then, subsequently exiting the medication room and heading out of the facility with the bag. She was then seen returning to the facility without the bag.
Furthermore, on June 1, 2017, the LVN voluntarily confessed to the Police Department that she removed two hundred forty tablets of Hydrocodone 10/325 from the nursing home by placing the tablets inside of her purse and then carrying her purse to her car.
The LVN disclosed to taking the Hydrocodone for her own personal use and consuming all of the tablets. Her conduct was likely to defraud the facility and patients thereof of the cost of medications.
During the defense, the LVN states that she took her purse her purse into the facility and left it in the medication room. She states once she completed her duties, she took her purse back to her car towards the end of her shift. The LVN further denies ever seeing the medications or ever having thein in her possession.
The Texas Board of Nursing then subjected the LVN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one. Hiring a nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.
