It was on or about July 28, 2017, while employed as a Licensed Vocational Nurse and assigned to provide skilled nursing to a patient, a quadriplegic ventilator-dependent patient with a tracheotomy, the LVN was observed to be sleeping while on duty by multiple family members and family friends. The LVN’s
conduct was likely to injure the patient in that it adversely affected his ability to recognize subtle signs, symptoms, or changes in the patient’s condition, and could have affected his ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.
In response, the LVN denies falling asleep. The LVN also states that he was facing the patient with his back to the doorway and that he heard the family talking and he did not acknowledge them because he did not realize they were talking to him. The LVN states the family could not have taken pictures of him allegedly sleeping because they were behind him and he was in a large recliner-type chair.
Because of this, the LVN was summoned by the Texas Board of Nursing to defend his side. However, his defense and lack of a proper nurse attorney to help him resulted in disciplinary action by the Texas Board of Nursing.
